We’re kicking off the new season with a breakfast seminar featuring two issues critical to developers: air space parcels and property tax.

David Longcroft will discuss the fundamentals of air space parcel subdivisions, and when it makes sense to use them in mixed-use and other projects. He’ll also examine some current issues with the approval and registration of air space parcel plans that have a direct impact on the timing and financing of air space parcel projects. David is a member of the Joint Task Force (on air space parcel subdivisions) of the Canadian Bar Association and the Association of British Columbia Land Surveyors. He is also the regional leader of the Business Department in BLG’s Vancouver office.
Paul Sullivan, a senior partner at Burgess Cawley Sullivan & Associates, will use recent case studies to review how developers can protect themselves from unnecessarily large tax bills stemming from both air space parcel subdivisions and “split class” tax assessments. In 2010, Paul led UDI’s Taxation Committee to successfully amend the regulation on vacant mixed-use development land. Prior to the amendment, mixed-use sites were often classified as 100% commercial; now, mixed-use may be considered “split class”. However, recent appeals have revealed shortcomings with the wording in zoning bylaws that have resulted in higher property taxes being paid by developers. Paul will share his thoughts on how zoning bylaws should be written to take full advantage of the amendment.
